TERMS AND CONDITIONS OF CONTRACTING
- The tourist tax is not included and will be paid on entry.
- The booking requires the acceptance of a €100 deposit.
- Entry from 4 PM to 10 PM. Vacating before 11 AM.
- Any cancellation made up to 10 days before arrival will be charged €1 plus 4% of the amount received and all bank expenses of the cancellation.
- Any cancellation within 10 days of arrival will suppose the loss of the amount paid at the time of booking (30% of the whole stay). Failure to appear at the scheduled day of arrival the establishment will mean the loss of 100% of the amount of the stay.
GENERAL CONDITIONS OF BOOKING
These General Conditions of Booking (hereinafter the General Conditions) will regulate the commercial relationship to be established between JELP 40 SL and the user or customer in contracting via the forms that JELP 40 SL makes available on its website www.marmuntanya.com.
Bookings via the JELP 40 SL websites will suppose the customer or user’s express acceptance of these conditions and of the conditions of use established for user browsing on the pages owned by JELP 40 SL.
These conditions are applicable notwithstanding the legal regulations on the matter applicable in each case.
The general conditions of contracting regulate the remote sales relationship between JELP 40 SL and the user or customer in accordance with the legal stipulations, and particularly Act 7/1998 of 13 April, regarding general conditions of contracting, Act 3/2014 of 27 March, by which the rewritten text of the General Consumer and User Defence Act, the current regulations on personal data protection, Act 7/1996 of 15 January on the organisation of retail trade, and Act 34/2002 of 11 July on services of the society of information and electronic commerce, are all modified.
JELP 40 SL reserves the right to make all changes it sees fit to the general conditions without prior notice. These changes may be made through its websites by any means admissible in law and shall apply for the time they are published on the website and until they are validly changed for others. However, JELP 40 SL in certain cases reserves the right to apply special conditions of contracting with preference over these General Conditions when it should see fit, announcing this in suitable time and form.
INFORMATION PRIOR TO THE BOOKING:
JELP 40 SL informs that the procedure for booking via its website is detailed in the corresponding section for the formalisation of the Booking.
Similarly, JELP 40 SL informs that the user may have access to the conditions of use available on the website itself.
For the Booking with JELP 40 SL via its website, the user or customer expressly declares that they know, understand and accept these conditions of use and the general conditions. The user similarly declares that they are of legal age and have the necessary legal capacity to access the websites of JELP 40 SL and to use them in contracting. The user accepts responsibility for treating the identity and password obtained in the customer registry in a confidential and responsible manner, and not to pass them on to others.
Once the booking has been made, the user will see the confirmation on the screen and may print it off as a receipt.
The booking confirmation and booking slip (printed out by the user) will not be valid as an invoice.
OPERATION OF THE BOOKING
OFFER OF BOOKINGS AND PRICE REFERENCE:
In accordance with current regulations and especially with Act 34/2002 on the services of the Society of information and electronic trade, JELP 40 SL offers information on all possible bookings, their characteristics and prices in the corresponding booking formalisation section. However, JELP 40 SL reserves the right to withdraw, stand off or change the offers it makes to its customers via its website by simply changing their content. In this way, the products and/or services offered at all times for the JELP 40 SL website will be governed by the general conditions in force for each case. The company will similarly be enabled to stop offering access to the mentioned products and/or services at any time, without notice.
Each possible booking offered will have its price indicated as well as any other applicable VAT or other tax, if necessary. The prices given on screen are those that hold at each moment, save typographical error. When the price is different for the reason given above, JELP 40 SL will inform the customer by email before charging for the booking.
The tourist tax is not included in the price of the booking and will be paid upon arrival.
A deposit of €100 will be left upon arrival and will be returned upon departure (if the apartment, furniture and utensils are in a good state and clean).
For the booking to be confirmed, it will have to be guaranteed by means of a valid credit card issued by a known banking institution (Visa, Mastercard and American Express credit cards are accepted).
The availability of the offers by JELP 40 SL through its website may vary depending on customer demand. Although JELP 40 SL regularly updates its database, the booking requested by the customer may not be available at the time. In this case, JELP 40 SL will send the customer an email informing them of the non-availability of the offer.
FORMS OF PAYMENT:
In bookings through its website, JELP 40 SL asks for the details of the credit card of the main person on the booking, in order to guarantee its effectiveness. The establishment will charge the credit card with 30% of the value of the booking when reserving.
CANCELLATION OF THE BOOKING:
Any cancellation made up to 10 days before the date of arrival will incur a cost of €1 plus 4% of the amount charged and all bank charges that might be derived from the cancellation.
Any cancellation made in the 10 days before arrival will suppose the loss of the amount paid at the time of the booking (30% of the total stay). The fact of not showing at the establishment on the planned date of arrival will suppose the loss of 100% of the cost of the stay.
If the user leaves before the date to which the stay was booked, the establishment may charge the full price for the services remaining.
CHANGE OF DATES:
There will be no penalty provided notice is given 10 days before the date of arrival, otherwise the conditions provided in the cancellation policy will apply.
According to article 103 of Act 3/2014 of 27 March, modifying the rewritten text of the General Act for the Defence of Consumers and Users, the supply of services or goods arranged according to the specifications of the consumer or in a clearly personalised manner, or those which cannot be returned or may deteriorate or expire rapidly due to their nature cannot be waived.
NAME AND IDENTITY OF THE CLIENTS:
The clients shall provide the name and identity of those who are going to occupy the apartment.
No more people than those stipulated in the contract will be allowed.
You are hereby informed that the data you provide over the contact form will be used to answer your requests for information and service.
They may similarly be used to send information, offers and news on our apartments.
At any time you may exercise your rights of access, rectification, cancellation and opposition by sending your request to the following address: carrer Balmes, 190 Baixos 08006 – Barcelona.
ARRIVALS / DEPARTURES:
The check-in is from Monday to Friday from 4 pm to 10 pm. Outside these times the establishment will have to be warned sufficiently in time for them to organise themselves.
The apartments must be vacated before 11 am. The expected departure time will be reported so that the apartment can be inspected and the deposit can be returned, if applicable.
SUPPLIES AND EQUIPMENT:
Sheets and towels in a number corresponding to the number of occupants of the apartment are included in the initial inventory.
The kitchen is equipped with the common utensils for cooking.
Water and electricity are included in the price.
The Apartments have a community laundry service (washing machine and dryer)
The apartments are supplied clean.
The daily cleaning is the responsibility of the tenant.
If the apartment is not in a fit state on the day of departure with respect to cleaning, the cost of cleaning will be discounted from the deposit.
The establishment accepts no liability for any damages that might be caused as a consequence of your stay in the apartment, including theft or fire.
The establishment accepts no liability either for personal objects or valuables that the clients might keep in the apartments, or for damage or robbery concerning vehicles in the car park, if applicable.
The establishment accepts no liability either for objects that are lost or forgotten when the client has checked out, but it will be attempted to return them if found.
The client will be responsible for their own behaviour and for that of those accompanying them.
If their behaviour should not be in accordance with minimal standards of coexistence, the establishment may require the apartment to be vacated without entitlement to total or partial refund for the days remaining, or any compensation.
No occupation will be accepted in excess of the number of places assigned for each apartment, which are: 2-bedroomed apartment (1 extra in double room) and 3-bedroomed apartment (1 supplementary in double room).
Each extra person will entail an additional charge of €22 per person and night. Only one child under 3 is exempt of additional charge.
Pets are allowed with an extra charge of €6 per night. No more than 2 pets per apartment are allowed.
As established by current regulations on the protection of personal data, we hereby inform you that your data will be included in the processing system held by JELP 40 SL with Tax no. B65399404 and registered address at BALMES 190 BAIXOS 08006, BARCELONA, in order to be able to facilitate, speed up and fulfil the commitments established between both parties. In accordance with current regulations, JELP 40 SL hereby informs that the data will be preserved for the time strictly necessary to meet the above-mentioned precepts.
We inform you that we will process your data in accordance with your consent and the contractual relationship we have with you.
JELP 40 SL informs that it will treat the data legally, loyally, transparently, adequately, pertinently, and in a limited, precise and updated manner. JELP 40 SL therefore agrees to take all reasonable measures to ensure that the data are suppressed or rectified without delay when they are imprecise.
According to the rights conferred by current data protection regulations, you may exercise all rights of access, rectification, limitation of processing, suppression, portability and opposition to the treatment of your personal data and the consent given there for by sending your request to the postal address indicated above or to the email email@example.com.
You may address the competent Control Authority to make any claims you see fit.
LEGISLATION AND APPLICABLE JURISDICTION
Similarly, JELP 40 SL reserves the right to take all civil or criminal actions that it sees fit in the event of undue use of its website or contents or any breach of these conditions.
The relationship between the user and the service provider will be governed by current regulations applicable in Spain. In the event of any dispute, the parties may submit their conflicts to arbitration or approach ordinary jurisdiction fulfilling all corresponding regulations on jurisdiction and competence.
